By signing up for any Highlands Defense class, you agree to agree all terms of service.
Indemnification
Every student is required to conduct themselves according to the safety rules provided at the beginning of every class. Students who fail to adhere to all safety rules may be removed from the class at the discretion of the instructor or any authorized person. No refunds will be given to students who are unable to complete a class due to safety violations.
All students agree to hold harmless Highlands Defense, LLC (including Zachary Hester, all employees, contractors, agents, and/or assistants) from any and all fault, liabilities, costs, expenses, claims, demands, or lawsuits related to a student's presence or participation in any class held by Highlands Defense, LLC. This includes any injuries, fatalities, or loss of property experienced by anyone present.
Students agree to assume all risk as a part of attending any class held by Highlands Defense, LLC.
Students agree that the training provided by Highlands Defense, LLC is not intended for any express intent or use of the skills or knowledge. Highlands Defense, LLC is not responsible for any future injuries, fatalities, or loss of property caused by any students.
Students agree to follow all local, state, and federal laws in the pursuit of their firearms instruction with Highlands Defense, LLC including those related to possession of firearms.
Prohibited Persons
Highlands Defense, LLC will not provide firearms instruction to any person prohibited from legally possessing a firearm. Prohibited persons include anyone who meets any one of the following qualifications:
- Felons
- Fugitives from justices
- Illegal immigrants
- Persons dishonorably discharged from any of the United States armed forces
- Persons who have been convicted in any court of a crime punishable by imprisonment for a term exceeding 1 year
- Persons who are unlawful users of or are addicted to narcotics or any other controlled substances (including medical marijuana)
- Persons adjudicated as a mental defective or who have been committed to a mental institution
- Persons who have renounced U.S. citizenship
- Persons convicted in any court of a misdemeanor crime of domestic violence
- Persons subject to a court order that restrains them from harassing,
stalking or threatening an intimate partner or child of such intimate
partner or person, or engaging in other conduct that would place an
intimate partner in reasonable fear of bodily injury to the partner or
child, with limited exceptions, provided the court order
was issued after a hearing of which such person received actual
notice, and at which such person had the opportunity to participate;
and
- includes a finding that such person represents a credible threat to the physical safety of such intimate partner or child; or
- by its terms explicitly prohibits the use, attempted use, or threatened use of physical force against such intimate partner or child that would reasonably be expected to cause bodily injury.
By signing up for a Highlands Defense class, you acknowledge that you are not a prohibited person.
Age Restrictions
Highlands Defense will provide training to anyone 18 years old or older. All students must be in legal possession of the firearm they intend to use.
Students who are under the age of 18 may make arrangements to attend with a parent or legal guardian present or taking the class. Please contact us prior to registering for a class to make appropriate arrangements. The parent or legal guardian assumes all risks and agrees to these terms of service.
Payments
Payments for classes may be made prior to a class via credit card. Payments must be arranged by calling 913-620-6873. Payments made the day of the class may be in the form of cash, check, or credit card. Payments before classes may be required. You will be contacted via email or phone if this is the case. All major credit cards are accepted.
If this is your first class with us, you may only sign up for one class. Once you have paid for and completed your first class, you may sign up for as many classes as you can commit to attending.
No-shows
Students who sign up and fail to attend a class without notice will be prohibited from attending all future classes. Any payments made prior to class will not be refunded or transferred to another class.
Student Cancellations
Students may cancel 48 hours in advance of the class to receive a refund on any payments made less a $20 cancellation fee. Students who cancel less than 48 hours before a class will not be refunded any payments.
Class Cancellations
Classes may be canceled at any time by the instructor due to weather, safety concerns, or a class that does not have the minimum number of students to conduct the class. The instructor will reach out to all students who have signed up for the class being canceled to let them know that class will not be held. Cancellations are generally announced more than 24 hours in advance, but weather related cancellations may be as late as the morning of the class in question. Instructors will communicate cancellations via email. Students who have prepaid their fees for the class can opt to be refunded in full or have their registration moved to another class (of equal value without additional payment).
In the event of a class that has to be ended before completion for any reason (including unexpected weather or other safety concerns), the instructor will make arrangements for a future partial class or permit students to transfer their registration to a different class of the same course.
